In the UAE, rent on commercial property such as an office, shop, warehouse or clinic is standard-rated at 5% VAT. Rent on a residential building is exempt, so no VAT is charged and the landlord cannot recover VAT on related costs. The first supply of a new residential building within three years of completion is zero-rated, and the sale or lease of bare land is exempt. If your business is VAT-registered and rents commercial space for its taxable activity, the 5% on your rent is normally recoverable as input VAT, provided you hold a valid tax invoice from a VAT-registered landlord. This guide explains each category, shows how to account for an office lease with real numbers, and covers mixed-use buildings, staff housing, Ejari and the mistakes that cost small businesses money. It is general information, not tax advice; confirm your position with the Federal Tax Authority (FTA) or a registered tax agent.

How is real estate taxed under UAE VAT?

UAE VAT law sorts property into four treatments. The use the building is designed and permitted for decides the treatment, not who the tenant is.

Type of supplyVAT treatmentCan the landlord or seller recover input VAT?
Commercial property: offices, shops, warehouses, hotels, serviced apartments with extra servicesStandard-rated, 5%Yes
First supply (sale or lease) of a new residential building within three years of completionZero-rated, 0%Yes
Any later sale or lease of a residential buildingExemptNo
Bare landExemptNo

Three definitions do most of the work:

Rule: Commercial rent is 5%. Residential rent is exempt. The first supply of a new residential building within three years of completion is 0%. Bare land is exempt. Exempt means no VAT on the rent and no input VAT recovery for the landlord.

Do you pay VAT on your office or shop rent?

Usually yes, if your landlord is VAT-registered. A lease of commercial premises is a standard-rated supply, so a registered landlord adds 5% to the rent and issues you a tax invoice. Service charges billed by the landlord under the lease generally follow the same 5% treatment.

Your landlord may not charge VAT in two situations:

  1. The landlord is not registered. VAT registration is mandatory once taxable supplies pass AED 375,000 over the past 12 months, or are expected to within the next 30 days. A landlord who owns a single small shop with annual rent of AED 90,000 and no other taxable business is below that line and may not be registered. Then there is no VAT on the rent and nothing for you to recover.
  2. The space is residential. A freelancer working from a rented flat pays exempt rent. There is no VAT to recover, even if part of the flat is used as an office.

Check the landlord's Tax Registration Number (TRN) on the FTA's TRN verification tool before you treat 5% on a rent invoice as recoverable. VAT charged by someone who is not registered is not input VAT you can claim.

Can you recover the VAT on your rent?

A VAT-registered business recovers input VAT on rent when three things are true:

You claim the VAT in the first tax period in which you hold the tax invoice and meet the payment condition. On the VAT201, rent goes in Box 9 (standard-rated expenses). Our step-by-step guide to the VAT201 shows where each figure lands.

When is the rent VAT due?

Rent is a periodic supply. The date of supply for each instalment is the earliest of: the date the landlord issues a tax invoice, the date the payment is due, or the date payment is received, with a 12-month backstop. In practice, if the landlord holds four post-dated cheques, each cheque date is generally a separate date of supply, and the landlord should issue a tax invoice for each instalment.

Worked example: a Dubai office lease

A design studio in Dubai, VAT-registered and making only standard-rated sales, signs a one-year office lease at AED 120,000 a year, paid in four cheques. The landlord is VAT-registered.

ItemAmount (AED)
Annual rent, net120,000
VAT at 5%6,000
Annual rent including VAT126,000
Each quarterly cheque (30,000 + 1,500 VAT)31,500
Input VAT recoverable per quarter1,500
Input VAT recoverable per year6,000

Each quarter, the studio records a bill from the landlord for AED 30,000 plus AED 1,500 VAT, enters AED 30,000 and AED 1,500 in Box 9 of that quarter's VAT201, and pays the cheque. The rent expense in the profit and loss account is AED 30,000 per quarter, not AED 31,500, because the VAT is recovered.

If the same studio rented a two-bedroom flat for AED 90,000 a year to use as an office, the rent would be exempt: AED 90,000, no VAT, nothing to recover.

What about the security deposit, Ejari and agent fees?

These are separate items with different treatment:

CostVAT position
Security depositGenerally no VAT while it is held as a refundable deposit. If the landlord keeps it as rent or compensation, VAT may then apply.
Ejari registration (Dubai)Dubai Land Department fee components plus a service partner fee. VAT applies to the service partner fee. The total is roughly AED 180 to AED 220 depending on the channel; check the current fee on DLD's site.
Real estate agent commissionA service, standard-rated at 5%. Recoverable on a commercial lease taken for your taxable business.
Fit-out and maintenance you contract yourselfStandard-rated at 5%. Recoverable if used for taxable supplies.
Municipality fees on DEWA billsMunicipal charges, not VAT.

Ejari is Dubai's tenancy contract registration system. Mainland Dubai businesses generally need a registered tenancy contract to issue or renew a trade licence. Other emirates have their own systems, such as Tawtheeq in Abu Dhabi. Registration does not change the VAT treatment of the rent; it is a legal step, not a tax one.

How do mixed-use buildings work?

A building with shops on the ground floor and flats above is two kinds of property for VAT. The shop rent is standard-rated at 5%. The flat rent is zero-rated on a first supply within three years of completion and exempt after that.

A tenant only looks at the unit it rents. An owner has more work, because input VAT on shared costs (the roof, lifts, common areas, building insurance) has to be split between taxable and exempt rent. Only the taxable share is recoverable. This is called apportionment.

Worked example: a small mixed-use owner

A company owns a building in Sharjah with one commercial unit and three flats, all let to long-term tenants for years.

ItemAmount (AED)
Commercial unit rent (5%)400,000
Output VAT on commercial rent20,000
Flat rent (exempt, not a first supply)100,000
Total rent500,000
Common-area repairs, net100,000
VAT on common-area repairs5,000
Taxable share of rent (400,000 / 500,000)80%
Recoverable input VAT (5,000 × 80%)4,000
Irrecoverable input VAT (becomes a cost)1,000

The commercial rent alone is above AED 375,000, so the company must be registered. Costs that relate only to the commercial unit, such as its own fit-out, are recovered in full. Costs that relate only to the flats are not recovered at all. Only shared costs are apportioned. The FTA's standard method uses the value of taxable supplies over total supplies, as above; a different method needs FTA approval.

Rule: Cabinet Decision No. 149 of 2026 changes the input VAT apportionment rules from the first tax year starting after 1 October 2027. If you own a mixed-use building, review the new method with your adviser before then. Our summary of the 2026 VAT Executive Regulations changes covers it.

Can you recover VAT on staff accommodation?

Usually there is nothing to recover. Renting a residential flat for an employee is an exempt supply, so no VAT is charged.

VAT appears when you house staff in a hotel or a serviced apartment with extra services, because those are commercial. Since 1 October 2026, Cabinet Decision No. 149 of 2026 allows input VAT on employee accommodation only where the Ministry of Human Resources and Emiratisation (MoHRE) requires the employer to provide it. Other employee benefits qualify where labour law requires them, or in cases the FTA specifies. If none of these applies, the VAT on a serviced apartment for a new hire is a cost, not a credit.

Five mistakes small businesses make with rent VAT

  1. Recovering VAT from an unregistered landlord. Check the TRN first. An invoice showing 5% from a landlord with no TRN does not support a claim.
  2. Recording rent as a plain expense. If your bookkeeping logs the AED 31,500 cheque as rent expense, the AED 1,500 of input VAT never reaches the return. Record the net rent and the VAT separately.
  3. Claiming without a tax invoice. A cheque stub or a lease contract is not a tax invoice. Ask the landlord for a tax invoice for each instalment.
  4. Treating a flat used as an office as commercial. The building's design and permitted use decide the rate. A residential flat stays exempt.
  5. Paying rent in cash. Under Cabinet Decision No. 149 of 2026, input VAT cannot be recovered on supplies above a value the Minister of Finance will set when paid in cash. That value had not been published as of mid-October 2026. Pay by cheque or bank transfer.

Keep every lease, tax invoice and payment record. VAT records must be kept for at least five years; for real estate, advisers cite 15 years.

From the platform: In Staks, record each rent instalment as a vendor bill with the 5% VAT on its own line, using the tax rate you set in Settings. A non-draft bill posts the net rent to your expense account and debits the input VAT to the Tax Payable account, so the VAT you can recover is not buried in the rent cost. Output VAT from your invoices credits the same account, so its balance for a period is output VAT less input VAT. Plain limits: Staks has no property or lease module, no VAT return report, and expenses post their gross amount with no VAT split, so rent you want to recover VAT on belongs in bills, not expenses. Bills and the ledger are on the Growth plan at $49 a month.

Frequently asked questions

Is VAT charged on commercial rent in Dubai?

Yes. Commercial rent is standard-rated at 5% everywhere in the UAE, including Dubai, when the landlord is VAT-registered. Ejari registration is a separate legal step and does not change the rate.

Is residential rent subject to VAT in the UAE?

No. The lease of a residential building is exempt, except the first supply of a new residential building within three years of completion, which is zero-rated. Either way, the tenant pays no VAT.

Can a freelancer recover VAT on a home office?

No. A residential flat is exempt, so the rent carries no VAT to recover. A VAT-registered freelancer can recover VAT on standard-rated business costs, such as a co-working desk from a registered provider.

Do I need to register for VAT if I rent out a shop?

You must register once your taxable supplies, including commercial rent, pass AED 375,000 over the past 12 months or are expected to within the next 30 days. You may register voluntarily from AED 187,500. Residential rent is exempt and does not count toward the threshold. See our guide to UAE VAT registration for small businesses.

Which VAT201 box does office rent go in?

Box 9, standard-rated expenses: the net rent and the 5% VAT on it, in the period you hold the tax invoice and meet the payment condition.

Check your landlord's TRN, get a tax invoice for every rent instalment, and record the net rent and the VAT separately so Box 9 is right each quarter. Start a 14-day free trial of Staks to keep your rent bills, VAT and ledger in one place.
